How many days can you request for a move and how to request them

Moving is a significant time of change, but it can also be a source of stress if not properly planned. Fortunately, labor law provides a right that can facilitate this process: paid leave for moving. Knowing how many days you are entitled to and how to request them will help you organize your move without affecting your workday or your salary.

According to Article 37.7 of the Workers' Statute, you are entitled to one paid day off when you move your habitual residence. This day must be granted by the company and does not involve a salary reduction. Some collective agreements may extend this leave to two days, especially if the move involves changing cities or provinces. Therefore, it is advisable to review the specific conditions of your sector before requesting it.

If you need more time, you can negotiate with your company to use vacation days, personal days, or adjust your schedule. The key is to plan ahead and submit your request with sufficient notice. To process it correctly, it is advisable to give notice at least 15 days in advance of the planned date and submit documentation that proves the change of address, such as a registration certificate, rental or purchase agreement, utility bills, or contract with the moving company you have hired.

It is important to note that the right to a permit does not depend on the volume of items you are moving. Whether you are moving a few boxes or large furniture and belongings, the permit applies as long as it is your habitual residence. This was confirmed by the Supreme Court in 1992. Only temporary moves or moves of second homes are excluded from this right.

There is no legal limit on the number of times you can request this permit per year, but each transfer must be duly justified to the company. Buckingham Property Advisors We understand that an organized move makes a difference.
