The tax value of a property is a key element in real estate taxation, as it determines the base upon which various taxes are calculated. Understanding how it influences each of them is essential for both buyers and sellers. 

One of the main taxes that depends on this value is the Property Transfer Tax (ITP). In this case, the tax authority establishes that the taxable base will be the higher value between the purchase price and the fiscal value. This means that, even if a home is acquired below that value, the tax will be calculated on the higher figure. 

Another relevant tax is the Personal Income Tax (IRPF), which affects the seller. Here, the tax value is used to determine the capital gain obtained from the transaction. Declaring a lower amount can lead to audits and adjustments by the Spanish Tax Agency. 

The Inheritance and Gift Tax is also directly linked to the tax value. In inheritances or donations, this value acts as a minimum base for calculating the amount to be payable. This prevents real estate from being declared below its real value and ensures taxation in line with the market. 

Furthermore, although it does not depend directly on the tax value, the cadastral value influences other taxes such as the property tax (IBI). It is important not to confuse the two concepts, as they serve different purposes within the tax system. 

A key aspect to keep in mind is that selling or buying below the tax value does not exempt you from paying taxes on it. The tax authority will always use the highest value as a reference, which can generate additional costs if it has not been properly anticipated. 

Therefore, before carrying out any transaction, it is advisable to know the fiscal value of the property and calculate the impact of the associated taxes. This planning helps avoid surprises and optimizes the financial management of the operation.
